政府职能转变过程中,越来越多的行政目标以签订合同的形式实施,而我国现有行政合同理论和法律规定均不完备,政府合同领域问题频发。为了规范政府合同,回应现实问题,近年来各地政府密集出台了多部行政规范性法律文件,~([2])本文选取了其中具有代表性的46件规定进行分析,发现地方政府的主要规制路径为通过政府内部法制机构进行合法性审查,而且各规定条文中均回避使用“行政合同”概念,并将规制范围扩张至各类不同性质的政府合同。这一探索具有明确的现实导向和较强的可操作性,但存在效力层级较低的问题和增设行政审批的嫌疑,应当从加强预算监督、增进公开和行政程序立法等方面着手,予以根本解决。
During the transformation of government functions, more and more administrative objectives are implemented in the form of signing contracts. However, the existing theory and laws of administrative contracts in our country are not complete, and the problems in government contracts are frequent. In order to standardize government contracts and respond to realistic problems, various local governments in recent years have issued many administrative normative legal documents intensively. In this paper, 46 representative regulations are selected for analysis and the main regulations of local governments are found The path is through the legality of legal institutions within the government review, and the provisions of the provisions are to avoid the use of “administrative contract” concept, and the scope of regulation to various types of government contracts. This exploration has a clear realistic direction and a strong maneuverability. However, if there is a problem with a lower level of effectiveness and an additional suspicion of administrative examination and approval, it should be fundamentally solved from the aspects of strengthening budget supervision and promoting legislation in open and administrative procedures .
