近年来,我国医患纠纷频发,医生的劳动权益屡屡受侵。医生劳动权包括就业权、劳动报酬权、休息休假权、劳动安全卫生保护权、提请劳动争议处理权、从事医学研究、接受继续医学教育、团体交涉权、集体争议权等,医生劳动权保护面临着职业安全权受到挑战、休息休假得不到保障、工资收入与劳动不成正比、人格尊严受到侵害、提请劳动争议处理权行使不畅等问题,明确医生工作的劳动属性、完善医生劳动权益保护的实体法,合理配置医疗资源,提高法律意识,真正实现管理法治化等措施从而保障医生的劳动权。
In recent years, frequent disputes between doctors and patients in our country and the doctor’s labor rights and interests have been repeatedly invaded.
