论非法转让土地使用权的构成要件

政府为满足土地使用权登记公示公信的需要,规定对有争议的土地使用权转让不予登记。转让有争议的土地使用权行为系违反《土地管理法》的行为,但与刑法所保护土地管理秩序无关。土地使用权一旦经过政府合法出让进入市场,政府就很难再行控制。政府只能是尽量在出让合同中明确出让人与受让人的权利义务关系,保证其土地开发目的的实现。设想以行政手段或者刑事处罚实现土地开发目的,保障土地管理秩序,并不现实。 The government, in order to satisfy the public need of registration of land use rights, stipulates that the transfer of disputed land use rights should not be registered. The transfer of contentious land use rights is a violation of the Land Administration Law, but it is not related to the order of land management protected by criminal law. Once the land-use right has been put on the market legally by the government, the government can hardly control it again. The government can only try to clarify the rights and obligations of the transferee and assignee in the contract of assignment and ensure the realization of the purpose of land development. Imagine the administrative means or criminal penalties to achieve the purpose of land development, land management order protection is unrealistic.
