当前不动产征收拆迁补偿实务中遇到了诸多制度或体制问题,如征收工作缺乏具体明确的法律指引、征收与拆迁补偿缺少衔接程序,强制拆迁或变相强制买卖中被拆迁人完全被动,更有个别地方官员滥用政府强制权力、侵犯被拆迁人的合法利益、民权无所保证。因此,本文提出不动产征收拆迁补偿立法应以保障民权为核心,既要考虑法律的内在秩序,也要考虑法规政策在实务中的可行性,在制度上做若干安排:征收必须事先听取利害关系人意见;取消强制拆迁制度;引入“征收决定”程序,区分征收决定和征收执行,征收执行阶段应明确“补偿”在“拆迁”之前;同时引入《拆迁授权证书》以提高法律的实效性。
