平衡不同国家之间的利益,尤其是发展中国家与发达国家之间的利益,是知识产权国际保护规则价值取向的内在要求和发展趋势之一。由于WIPO和TRIPS这两个并行运作的知识产权国际保护体系的宗旨和运作机制等不尽一致,在平衡南北利益时存在价值冲突、导致发展中国家利益受损在所难免。因此,国际社会应在摒除发达国家知识产权霸权主义的基础上,对WIPO和TRIPS的职能进行分流并加强其间的交流与合作,构建二者既有专业化分工又有相互促进的新型合作模式,以此在协调其价值冲突、有效保护知识产权的同时平衡南北利益。
Balancing the interests among different countries, especially between developing countries and developed countries, is one of the intrinsic requirements and trends in the value orientation of the rules on the international protection of intellectual property. Due to the inconsistency between the purpose and operating mechanism of WIPO and TRIPS, two parallel systems of international protection of intellectual property rights, there is a value conflict in balancing the interest of North and South, which will inevitably damage the interests of developing countries. Therefore, on the basis of excluding developed countries’ hegemony of intellectual property rights, the international community should divert the functions of WIPO and TRIPS and strengthen exchanges and cooperation in the process. Both sides should establish a new type of cooperation mode with both specialized division of labor and mutual promotion. In this way, it can balance the interests of North and South while coordinating its value conflicts and effectively protecting intellectual property.
