农村宅基地使用权,是根据我国的土地制度发展起来的一项独特的物权属性。但现行的法律制度对于农村宅基地使用权的权能规定是不完整的,未明确规定是否可以继承,影响了其作为生产要素的基本价值的发挥。文章从我国农村宅基地使用权的历史沿革出发,阐明我国农村宅基地使用权的来由、独特性及目前法律、法规关于农村宅基地的相关规定,列出学术界对农村宅基地能否继承的两种不同观点,分析农村宅基地使用权应当可以继承的理由,并提出构建农村宅基地使用权继承制度的思路,以期能为繁荣农村经济、增加农民财富、缩短城乡差距提供参考。
The right to use house sites in rural areas is a unique attribute of property developed in accordance with China’s land system. However, the existing legal system does not provide a complete set of rules for the right to use land in rural residential sites. It does not specify whether inheritance can be inherited or not, thus affecting the development of basic values as a factor of production. Based on the historical evolution of the right to use house sites in rural areas of our country, this essay expounds the origin and uniqueness of the right to use house sites in rural areas in our country and the relevant laws and regulations on rural house sites, and lists whether academia can inherit rural house sites This paper analyzes the reasons why the right to use rural house sites should be inherited and puts forward the idea of building a right of inheritance of rural house sites so as to provide a reference for prospering the rural economy, increasing farmers’ wealth and shortening the gap between urban and rural areas.
