根据国际法律文件,只有在一国违背的国际义务是对整个国际社会所承担的义务,而该义务属于国际强行法规范所规定的义务,国际法才可能将该行为规定为国际犯罪。国家犯罪概念中的关键问题就是:如何界定国际犯罪与国家行为。国家犯罪是以国家作为犯罪主体的国际犯罪;国际犯罪是危害国际社会,为国际刑事规范所禁止,且应承担国际刑事责任的行为。因此,国家犯罪是一种国家行为,只有国家行为所违背的义务对保护国际社会的根本利益至关重要,并被国际法明确规定违背该项义务的行为是犯罪时,才构成国家犯罪。

Therefore, the state crime is a state act, and only the obligation violated by the state act is of utmost importance for the protection of the fundamental interests of the international community. It is a crime committed by the international law only when the violation of the obligation is a crime, thus constituting a national crime.
