不动产登记是物权对世效力和公示原则的基本要求,但我国尚无不动产登记法。目前我国不动产登记制度中的明显不足就是理论基础模糊不清,制度设计简单粗糙,缺乏可操作性。现行有关不动产登记的法律不仅零散,而且存在不少错误,有的甚至违反物权法的基本原则,这种制度缺陷直接危及当事人的切身利益与市场交易的秩序与安全。本文分析了我国不动产登记制度中存在的主要缺陷,以期有利于完善我国的不动产登记制度。
Real estate registration is the basic requirements of the real right and the principle of publicity, but there is no real property registration law in our country. At present, the obvious deficiency in the real estate registration system in our country is the unclear theoretical foundation, the simple and crude system design and the lack of operability. The existing law on real estate registration is not only fragmented, but also has many mistakes. Some of them even violate the basic principles of property law, which directly endanger the immediate interests of the parties and the order and security of market transactions. This article analyzes the main defects of the real estate registration system in our country, with a view to improving our country's real estate registration system.
