征地补偿安置是土地征收过程中一个重要的具体行政行为。征地补偿安置争议解决制度事关征收相对人及利害关系人的利益,处置不好会使征地矛盾恶性循环。《国法[2011]35号》对于规范和统一征收补偿安置争议解决制度具有积极意义,但其对行政复议申请人范围规制的不足会在实践中掣肘其执行力。可以提起行政复议的主体包括土地所有权人、土地承包经营权人、承包经营权流转的受让人、集体建设用地使用权人、集体建设用地使用权流转的受让人以及其他土地权利人。
Land acquisition compensation and resettlement is an important specific administrative action in the process of land acquisition. The system of dispute settlement for land acquisition and resettlement concerns the collection of the interests of the relatives and the interested parties. If not handled properly, the contradictions in the land acquisition will be vicious circle. “National Law [2011] No. 35” is of positive significance for standardizing and unifying the system of dispute settlement for requisition and resettlement, but its lack of regulation over the scope of applicants for administrative reconsideration will limit its execution in practice. The subjects of the administrative reconsideration may include the landowner, the contractor of the land contract, the assignee of the circulation of the contractual management right, the owner of the collective construction land, the transferee of the circulation of the usufruct of the collective construction land, and other land owners.
