在《中华人民共和国公务员法》中,领导成员辞职有四种形式:因公辞职、自愿辞职、引咎辞职和责令辞职。每种形式与问责都有不同的关系,其中自愿辞职、引咎辞职与责任的关系比较复杂。自愿辞职又可以分为无道义过错自愿辞职和道义过错自愿辞职两种形式,引咎辞职与西方语境下“引咎辞职”含义差别巨大。因此,在公务员辞职的制度化上,各种责任的明确、辞职程序的建设和后续管理上有着鲜明的中国特色。
In the Civil Service Law of the People’s Republic of China, there are four forms of leadership member resignations: resigning from office voluntarily, resigning voluntarily, resigning from office, and resigning from office. Each form has a different relationship with accountability, of which the relationship between voluntary resignation, blame resignation and responsibility is rather complicated. Voluntary resignation can be divided into voluntary resignation without moral injustice and voluntary resignation by moral fault. The resignation of resignations is quite different from the meaning of “resigning from blame and resignation” in the western context. Therefore, in the institutionalization of the resignation of civil servants, there are distinct Chinese characteristics in defining various responsibilities, resigning procedures, and follow-up management.
