近年来,网络游戏侵权问题不断涌现。在现有的三种网络游戏保护模式中,计算机软件作品保护模式已不能适应我国游戏产业的发展,且暂无再新创设一种单独作品类别的必要性,因此通过对网络游戏要素予以定型化保护,给予网络游戏整体、全面的保护是最佳路径。为此,必须着重分析游戏名称、游戏标识、画面布局、游戏规则等网络游戏要素是否属于《中华人民共和国著作权法》意义上的作品以及属于何种作品类型。目前,在网络游戏要素著作权保护的司法实践中,“接触+实质性相似”标准本身及其运用尚有一定疏失,应当参考域外经验总结网络游戏要素视角下的著作权侵权判定新标准。
