在党的十八大提出大力发展海洋经济,保护海洋生态环境,维护国家海洋权益,建设海洋强国战略思想下,最高人民法院适时提出把我国建设成为具有较高国际影响力的国际海事司法中心的目标,并在2016年3月和8月,先后发布《关于海事法院受理案件范围的规定》《关于海事诉讼管辖问题的规定》《最高人民法院关于审理发生在我国管辖海域相关案件若干问题的规定(一)》与《最高人民法院关于审理发生在我国管辖海域相关案件若干问题的规定(二)》。上述四个司法解释虽然在一定程度上有了回应,但仍存在一些空白或不明之处。所有涉海的案件是否均为海事案件,所有的海事案件是否都归属于海事法院管辖,对此,应当厘清“海事案件”内涵之标准,明确海事法院“三审合一”的管辖权范围,从而更好地发挥国际海事司法中心的引领作用。

Although the above four judicial interpretations have responded to some extent, some gaps or ambiguities still exist. Whether all the cases involving the sea are maritime cases and whether all the maritime cases belong to the jurisdiction of the maritime court, we should clarify the standard of the connotation of ”maritime cases“ and clarify that ”maritime courts" Jurisdictions so as to give better play to the leading role of the International Maritime Justice Center.
