陪审制是英美法系中具有特色的法律制度,在历史上,陪审制作为一种民主的象征而被广泛采用,是抵御非正义的堡垒和与自由民主相称的一种制度。因而,陪审制首先是一种政治制度,扮演的政治角色要比司法角色更为重要。评价陪审制需从其历史发展着手,回顾不同阶段陪审制的发展及其所扮演的政治角色,在此基础上探讨在现代政治体制中陪审制所体现的政治价值。
Jury system is a distinctive legal system in Anglo-American legal system. Juries system has been widely adopted as a symbol of democracy in history. It is a system against injustice and freedom and democracy. Thus, jury system is first and foremost a political system that plays a more political role than a judicial one. Evaluation jury system should start from its historical development, review the development of jury system in different stages and its role in politics, on the basis of which to explore the political value embodied in jury system in modern political system.
