生态补偿是当前学界关注的热点问题,对生态补偿的法学研究处于起步阶段。结合国内外已有的生态补偿理论,对我国生态补偿法律制度的作了基本考察,介绍了我国生态补偿法律制度的基本现状、指出了我国生态补偿法律制度的不足之处,并提出了完善方向,以此推动我国生态补偿法律法规尽早出台,使生态补偿法律制度成为我国环境保护的一道坚实法律屏障。
Ecological compensation is a hot issue that scholars pay close attention to at present, and the legal research of ecological compensation is in the initial stage. Based on the existing theory of ecological compensation at home and abroad, this paper makes a basic survey of the legal system of ecological compensation in our country, introduces the basic status quo of the legal system of ecological compensation in our country, points out the shortcomings of the legal system of ecological compensation in our country, So as to promote the early promulgation of laws and regulations on ecological compensation in our country and make the legal system of ecological compensation a solid legal barrier for environmental protection in our country.
