：
“亲亲相隐”制度在我国古代社会中发挥着十分重要的作用,但基于历史的原因,我国法律贯彻“亲亲不得首匿”原则,导致亲属在人性与法律间进行挣扎,不利于家庭和谐、社会稳定。

“亲亲相隐”制度在我国古代社会中发挥着十分重要的作用,但基于历史的原因,我国法律贯彻“亲亲不得首匿”原则,导致亲属在人性与法律间进行挣扎,不利于家庭和谐、社会稳定。因此,笔者试图在了解古代“亲亲相隐”制度的基础上,对“亲亲相隐”制度在现代法律中存在合理的生存空间进行分析,进而为建构我国亲属拒证权制度奠定基础。
