网上购物一方面因其便利、廉价的优势,已经受到越来越多的消费者青睐,另一方面又因其交易的特殊性较之普通购物更容易侵犯消费者的合法权益。由于我国目前对网上交易的规制不健全,网上购物中消费者的合法权益保护面临严峻挑战。本文通过分析网上购物的特点,借鉴其他国家的立法经验,对建立并完善我国网上购物中消费者权益保护的法律体系提出几点建议。
On the one hand, online shopping has been favored by more and more consumers due to its convenience and low cost. On the other hand, because of the special nature of its transactions, it is more likely to violate the legitimate rights and interests of consumers than ordinary shopping. Due to the current regulation of online transactions in China is not perfect, the protection of consumers’ legitimate rights and interests in online shopping is facing severe challenges. Based on the analysis of the characteristics of online shopping and the legislative experience of other countries, this article puts forward some suggestions on how to establish and improve the legal system of consumer rights protection in online shopping in China.
