预租登记制度是房地产预租问题中的一项重要内容。预租制度本身尚未为我国立法所明确,预租登记更未被立法所提及。实践中,商品房预租现象由来已久,但在缺乏立法规制情形下,预租登记的效力并不为法律所明确。本文旨在探讨商业地产预租登记的效力问题,并就此提出相关对策,以期制度完善。
Pre-registration system is an important part of real estate pre-leasing issues. The pre-leasing system itself has not been clearly defined in our country’s legislation. The pre-registration has not been mentioned in the legislation yet. In practice, the phenomenon of pre-renting of commercial housing has existed for a long time, but in the absence of legislative regulation, the effect of pre-registration is not clear by law. The purpose of this paper is to discuss the validity of the pre-registration of commercial real estate and to put forward relevant countermeasures so as to improve the system.
