我国现行刑法对于食品安全的保护存在明显的缺陷,只处罚故意犯罪,对过失犯罪没有规定,实践中要么按不构成犯罪处理,要么在各种压力下生搬硬套进行处罚。现行刑法主观罪过狭窄,与《食品安全法》不衔接,不利于有效打击危害食品安全犯罪。综合考虑我国发展现状和世界各国的规定,本文认为我国应该考虑将危害食品安全犯罪的主观罪过由故意形态拓展至包括过失形态在内,建议增设食品安全事故罪,同时增设资格刑以更好地维护人民群众的食品安全。
The existing criminal law in our country has obvious defects in the protection of food safety. It only punishes intentional crime and does not stipulate negligent crimes. In practice, either it does not constitute a crime or imposes punishments under various kinds of pressure. The current criminal law has a narrow subjective sin and does not link with the “Food Safety Law,” which is not conducive to effectively cracking down crimes that endanger food safety. Considering the current situation of development in our country and the regulations of other countries in the world, this paper argues that our country should consider extending the subjective sin of endangering food safety crime from the deliberate form to the form of negligence, recommending the addition of the crime of food safety accident and adding the qualification punishment to better Maintain food safety of the people.
