抗癌化疗药物由于具有细胞毒性,可对药师、护士等工作人员构成潜在的健康危害,因此,医疗院所应提供负压洁净室系统、层流抽风柜、调剂作业标准与个人防护措施,以尽可能降低暴露,维护员工健康。台湾各级医院对此已有相应规范,属于医院评鉴重点项目。因化疗药物导致工作人员的疾病也已纳入职业病种类表中,能够得到补偿。本文报告一位药师因脱发就医,检测出尿与发中铂含量增高,遂提起民事诉讼,要求“侵权行为与减少劳动能力”赔偿,合并精神抚慰金。法院审理,以脱发和化疗药物暴露之间存在因果关系为由,判决原告胜诉。本文就判决意旨与医学文献进行讨论,探究此案之医学事证,允为借镜。此外,由于“职业病”之概念与大陆尚存差异,故本文仅供参考。
Because of their cytotoxicity, anticancer chemotherapeutic drugs pose a potential health hazard to pharmacists, nurses and other staff members. Therefore, medical institutions should provide negative pressure clean room systems, laminar flow hoods, adjustment of operating standards and personal protective measures to Minimize exposure and maintain employee health. This article reports a pharmacist who was diagnosed with hair loss and detected an increase in the amount of platinum in the urine and hair and filed a civil lawsuit asking for compensation for the “infringement and reduction of work ability” and the spirit of merging. Court hearing, hair loss and chemotherapy drug exposure between the existence of a causal relationship between the verdict, the plaintiff won. This article discusses the purpose of the judgment and the medical literature to explore the case of medical evidence, allow for the mirror.
