本文阐述了作者初识GATT的过程以及对GATT/WTO的理解。尽管作者不是政府官员也不是办案律师,但每当阅读WTO争端解决机制涉及中国案件的裁决时,心情总是不能平静并产生许多烦恼和无奈。由于中文不是WTO协定的正式语言,专家小组在涉及词语解释时,表现得过于强势;在涉及入世议定书性质及与WTO协定的关系问题上,WTO不应表示沉默。专家小组和上诉机构的法官们乐于展示其才华,却丝毫没有顾及到国人的感受。由于中文不是WTO的工作语言,中国在入世议定书中承诺了什么,按照自己的理解说了不算,要人家解释说你说了什么才算,只需想想就让人崩溃!工业革命后英国的霸主地位以及第二次世界大战后形成的欧美一超多强的局面,促成并维持了英语的强势地位。看来中文要成为国际商务通用语言,成为国际组织的官方语言,大概就是中国成为大国并是强国的那一天。作者强调,语言真的不仅仅是工具,而是活生生的话语权!
This article explains the process by which authors first learned about GATT and their understanding of GATT / WTO. Although the author is not a government official or a case lawyer, whenever he reads a WTO dispute settlement decision involving a Chinese case, the mood can not always be calm and generate much trouble and frustration. Since Chinese is not the official language of the WTO agreement, the panel of experts performed too strongly when it comes to the interpretation of terms. The WTO should not express silence on the issue of the nature of the WTO accession agreement and its relationship with the WTO agreement. Judges of panelists and appeal agencies are happy to showcase their talent without taking into account the feelings of the people. Since Chinese is not the working language of the WTO, what China promised in its WTO accession agreement does not mean it according to its own understanding. People should explain what you are saying and just think about it. After the Industrial Revolution, the United Kingdom Dominance of the United States and the United States after the Second World War formed more than one strong situation, contributed to and maintained a strong position in English. It appears that to become a common language for international business and to become the official language of an international organization, it is probably the day when China becomes a great power and a power. The author emphasizes that language is really more than a tool, but a living discourse!
