一、案件情况:甲方(出租方):上海XXX小商品城有限公司(国内合资企业)乙方(承租方):黄XX(自然人)所出租的房屋只有大产证,没有小产证,现甲方决定将其中有关使用面积出租给乙方,为此签订的《房屋租赁合同》申请办理公证。上述案件情况系由笔者在公证接待时,当事人向笔者咨询介绍的真实案件。笔者在简单思索后的直觉是“本案中所涉法律关系比较复杂”。于是作为接待人先行留下当事人的联系方式,并告知对方待公证处慎重考虑后予以回复。在进入对本案件讨论前,笔者还是简单将“大、小产证”的情况说明一下。所谓大产证,是在房屋竣工验收之后交付购房者之前,由房地产开发商向房地产管理部门申
