作为推动我国司法民主的重要制度,人民陪审员制度几经更迭,发展至今,并未实现制度设计的初衷,“陪而不审”“审而不议”等成为常见的现象。文章从人民陪审员制度的背景出发,溯源制度发展的历史,并分析该制度现今发展主要存在的问题与困境,以此提出制度改革的路径设计,为我国人民陪审员制度的发展和司法民主的保障提供动力。 As an important system to promote judicial democracy in our country, the system of people’s jurors has been changed and developed so far, and the original intention of system design has not been realized.
