2014年12月19日,广东高院对加多宝饮料诉王老吉大健康不正当竞争案作出一审判决。在该案中,广东高院把“知名商品”作为争议焦点和论证的起点的做法是值得商榷的,因为“知名商品”本身是一个伪概念,会给纠纷的解决带来诸多问题。正确的做法是回归《反不正当竞争法》第五条的制度本源,首先判断涉案商标“红罐装潢”是否欠缺显著特征,即是否能够用来识别其商品来源;然后再判断其是否具有知名度,是否已经使得外表装潢与其实物来源之间建立了唯一联系;最后依据联系所指向的主体确定装潢的归属。
