自网络产生后,其不仅给人们的生产和生活方式带来了较大的变化,而且也加快了军事领域的一系列变革,由此产生“网络战”这一新的作战方式。随着网络攻击及网络战的威胁不断增加,以美国为首的西方国家主张现有国际法可以适用于网络空间和网络战,并基于此观点,北约于2013年推出《塔林网络战国际法手册》,这是目前关于网络安全规则方面唯一一份具有普遍意义的文件,但由于没有得到普遍承认,因此不构建直接的法律约束力。但对于制定网络战规则及参与全球网络空间行为准则的制度具有一定的参考价值。
Since the birth of the Internet, it not only brought great changes to people’s production and way of life, but also accelerated a series of changes in the military field, resulting in a new “war on networks” approach. With the growing threat of cyberattacks and cyberwarfare, the Western countries headed by the United States advocate that existing international law can be applied to cyberspace and cyberwarfare. Based on this view, NATO launched the Tallinn Cyberwarfare Handbook of International Law in 2013, which Is currently the only document of general relevance for cyber security rules that has not been directly legally binding since it is not universally acknowledged. But it is of certain reference value for the formulation of cyberwar rules and the system of participation in the cyberspace code of conduct in the world.
