趋利避害是人的本性，防卫意识是人的一种本能，正当防卫是始终关注“人”的一项保障权利，也是一个古老而常新的话题。作为一种积极的法律行为，正当防卫高度体现了目的的正当性与行为的防卫性的统一、主观上的防卫意图与客观上的防卫行为的统一、社会政治评价与法律评价的统一。鉴于我国目前治安状况的严峻形势，新刑法确立了新型的“特殊防卫权”，赋予人们更宽泛的防卫权利，但并不意味着新的防卫权是无限度的。

As a positive legal act, legitimate defense highly embodies the legitimacy of purpose and the defensive unity of conduct, the unification of subjective defense intention and objective defense behavior, and the unification of social and political evaluation and legal evaluation. In view of the current grim situation of law and order in our country, the new criminal law has established a new type of “special defense right” that gives people more extensive defense rights, but it does not mean that the new defense right is unlimited.
