一般认为,我国现行的诉讼离婚是以客观标准为标志的“感情破裂”说:即原则上以感情是否破裂作为婚姻解除的实质要件,并附以能为大众所识别的夫妻生活的外在状态,如是否分居、有无家庭暴力、一方有无恶习来确认此要件是否成立。但是以客观要件来定义主观标准本身听起来就有悖逻辑,且这些标准是否能够周延的和主观状态划上等号也不无疑问。本文借鉴国外相关立法实例,分析了国内现行诉讼离婚标准的利弊,并在此基础上提出了若干立法建议。

But defining subjective criteria in terms of objective elements sounds paradoxical, and it is not without doubt whether these standards are equitably extended or subjective. This article draws lessons from the relevant foreign legislation examples, analyzes the advantages and disadvantages of the current domestic lawsuit divorce standards, and on this basis puts forward some legislative suggestions.
