《TRIPS协议》之后,除了世界知识产权组织主持制定了《因特网版权条约》(包括《版权条约》和《表演和录音制品条约》)之外,国际知识产权版权协议的制定逐渐从世界知识产权组织和世界贸易组织转向了自由贸易协定(含有版权协定),如双边贸易协定(FTA)、多边贸易协定(如反假冒协议)及近来美国主导的跨太平洋伙伴协议(PPT)。其中美国《跨太平洋伙伴协议版权草案》与以前的知识产权协议的规定相比,保护标准更高,该草案继续强化版权保护期限、范围、执行措施,但对版权的限制、例外及使用者的合法利益保护不足。
Following the TRIPS Agreement, in addition to the WIPO Copyright Treaty (including the “Copyright Treaty” and the “Performances and Phonograms Treaty”), which under the auspices of the World Intellectual Property Organization, the development of an international agreement on intellectual property rights has been progressively drawn from the World Intellectual Property Organization And the World Trade Organization have turned to free trade agreements (including copyright agreements) such as FTAs, multilateral trade agreements such as anti-counterfeiting agreements and the recent U.S.-led Trans-Pacific Partnership (PPT). Among them, the draft “Transatlantic Partnership Agreement” in the United States has a higher standard of protection as compared with the previous agreement on intellectual property rights. The draft bill continues to reinforce the term, scope and enforcement measures of copyright protection. However, restrictions on copyright, exceptions and users’ Legal protection is not enough.
