“禁烧秸秆”和“烧秸秆”是一组基层政府环境治理与农村农业生产习惯之间矛盾的体现。随着“雾霾”问题从环境化向社会化转变,基层政府在处置“烧秸秆”行为引发环境污染问题上尽其所能,但是村民基于传统的自然习惯和农业生产的成本考量,仍无法完全放弃“烧秸秆”的行为。对此在治理手段上,基层政府对公权力的应用是否合宪以及正当,以及农民坚持烧秸秆行为是一种“公民冷漠”还是能够得到法律宽容,都值得深入探究证立。这种自然习惯与环境治理间冲突的调和路径可能在于降低村民守法的成本与保障执法的程序正义。

The reconciliation path between this natural habit and the environmental governance may lie in reducing the cost of law-abiding villagers and ensuring the procedural justice of law enforcement.
