有观点认为,当在先著作权与在后商标权发生冲突时,如适用著作权侵权判断的通常思路和标准,而不予特别考量,则无异于赋予相关在先作品“超级驰名商标”的地位——使其无需知名度,即可阻却相同、近似的标识在任何类别上的注册或者宣告其无效,且几乎不受地域限制。持此种观点者往往以“超级驰名商标”冲击了商标法的基本制度为由,主张在处理在先著作权和在后商标权之间的冲突时,采取特殊的著作权侵权判断标准,甚至不向专为商标设计的标识提供著作权保护。笔者认为,“超级驰名商标”概念产生的原因在于裁判者在保护在先著作权还是袒护在后商标权这一问题上的基本立场摇摆不定,忽视了著作权和商标权的性质差异,用商标权的保护逻辑去衡量著作权的保护结果。事实上,遵循一般著作权侵权判断的通常思路和标准去保护在先著作权,对商标法律制度的冲击十分有限,“超级驰名商标”其实名不符实。故应为在先作品去妖魔化,在理解权利冲突的解决不可能两全其美的基础上,坚持以保护在先著作权为核心,回到著作权法去保护在先著作权。
