中国宪法文化历来是舶来品。然而在宪政传来前仍然有其替代物维持社会运转。宪法理念传来中国则必须与本土的文化相融合。而对于现存的断层局面以及本土文化被迫让渡到隐匿的地步不得不再次唤起对中国本土习俗的重视。本文试从萨摩亚宪政的演进历程审视中国宪法文化危机,呼吁关注中国的习惯法,以求得宪政的深入演进。 Chinese constitutional culture has always been a foreign product. However, there are still alternatives to maintaining social order before constitutional government. The idea of ​​constitution came to China must be integrated with the local culture. However, for the existing fault situation and the local culture forced to surrender to the hideaway, it has to arouse again the emphasis on the customs of China. This article attempts to examine the constitutional crisis in China from the evolutionary history of Samoa constitutional government and calls for attention to China’s customary law in order to achieve the in-depth development of constitutional government.
