20世纪末,台湾地区为了推动历史建筑保护,实施发展权移转制度。此制度实施迄今,可观察到对历史建筑保护帮助极大,但也衍生部分课题。故以台北的经验个案为例,经由资料汇整与分析,探讨发展权移转制度应用于历史建筑保存的成败得失,以兹借镜。研究发现,发展权移转制度于台湾地区最初系由民间非政府组织与学者专家推动,用以缓和私有文化资产物业主抗拒历史保护造成的冲突,嗣后逐渐制度化于大范围的历史街区风貌保护,近期更成为政府与开发商协商的重要工具,如可进一步调整相关配套,对文化资产保护将更有帮助。
At the end of the 20th century, in order to promote the protection of historic buildings, Taiwan implemented the transfer system of the right to development. Since the implementation of this system, it has been observed that it is of great help to the protection of historic buildings, but some issues have also been spawned. Therefore, taking the case of Taipei as an example, this paper explores the success or failure of the transfer of the right of development system to the preservation of historical buildings through the data collection and analysis. The study found that the system of the transfer of development rights in Taiwan was originally promoted by non-governmental non-governmental organizations and scholars in order to ease the conflicts caused by the owners of private cultural assets in resisting historical protection and then gradually institutionalized the protection of the appearance of a wide range of historical districts In recent years, it has become an important tool for the government to negotiate with developers. For example, it is possible to further adjust the related facilities and help protect cultural assets.
