检察机关是国家机关,本身属于政治上层建筑的范畴。检察机关的基本职责是行使作为国家权力之一的检察权。因此,检察改革必然涉及检察职权的配置和调整的问题。从检察改革十年来走过的历程看,检察改革的绝大部分任务,都与检察职权的配置和行使有关。检察改革之所以始终是围绕着检察职权配置进行的,是因为优化检察职权配置是检察改革始终不变的目标。检察改革如果缺乏对检察职权配置系统清晰的认识,如果没有明确的方向,如果违背权力配置的基本规律,就会盲目进行,就难以达到党和人民满意的效果,甚至连检察机关自身的要求都不能满足,并且可能使今天的改革成果成为明天的改革对象。这样的改革,难免走上循环往复、无穷无尽的道路。本刊编辑部认为,在检察改革中,只有充分考虑检察职权配置的优化问题,科学合理地配置检察职权,才有可能保证这些职权的充分有效行使,才有可能通过检察改革推进检察工作的科学发展。为了充分探讨这一问题,本刊编辑部以“司法改革与检察权优化配置问题研究”为总标题进行专题研究,试图从国家权力的分配和优化,以及现代司法的基本规律和特点着手,就我国检察权优化配置的相关问题进行探讨。本着百家争鸣的态度,本刊对于受邀专家的来稿,只要符合通常的学术规范,不论其所表达的学术观点如何,均一律照登,所以,本专题所有观点均不必然代表本刊编辑部之立场。
