为了保护消费者的利益,《食品安全法》规定了十倍赔偿,似乎反映了立法者保护消费者的决心;但是,该规定在实践中基本上成为一纸废法,既没有体现消费者权益的保护,更没有解决食品安全问题。在食品监管乏力的形势下,应重树食品安全的惩罚性赔偿制度,让社会专业人士和专业机构以此为基础,参与食品安全法的执行,协同监管部门执法,形成立体执法体制,开创食品安全监管新模式。
