贷款难问题一直是制约“三农”发展的一个瓶颈,其关键原因之一,就是农户缺少法律允许范围内可供抵押的财产。除了房和地,农户几乎没有其他财产,但农户获得的土地承包经营权和宅基地是集体所有,依据《物权法》规定,集体所有的土地使用权不得抵押。山东省寿光市大胆进行土地流转贷款方式的改革,在可控的范围内进行农村住房、大棚和土地承包经营权抵押贷款的试点推广,效果良好。本文主要对寿光农村贷款改革的事件进行梳理,并总结其采取的具体风险防控措施,最后分析其成功经验。
The difficult loan problem has always been a bottleneck restricting the development of “agriculture, rural areas and farmers”. One of the key reasons for this is that farmers lack property available for mortgage under the law. Except for houses and land, peasants have almost no other property, but the land contractual management rights and house sites acquired by peasants are collectively owned. According to the “Property Law”, collective-owned land use rights are not allowed to be mortgaged. Shouguang City, Shandong Province, boldly carry out the reform of land circulation loans and carry out the pilot promotion of rural housing, greenhouses and land-use right mortgage loans within the controllable range, and the results are good. This paper mainly sorts out the events of Shouguang rural loan reform, and sums up the specific risk prevention and control measures taken by it, and finally analyzes its successful experience.
