中国发起的“一带一路”战略让以哈萨克斯坦为典型代表的广大中亚国家从中受益,经济实力与地区影响力不断增强,引起世界瞩目。日本虽未参与“亚投行”的出资,但与哈萨克斯坦等中亚国家的经贸往来频繁。本文以两国公司法为基础,通过比较双方关于股份转让的限制,并结合中国的相关法律条文,力求得出一个合理化的分析。
The “Belt and a Road” strategy initiated by China has benefited the vast number of Central Asian countries represented by Kazakhstan as a typical Central Asian nation, and has drawn world attention because of its growing economic strength and regional influence. Although Japan has not participated in the investment in the “AIIB”, its economic and trade contacts with Central Asian countries such as Kazakhstan are frequent. Based on the Company Law of the two countries, this article attempts to draw a rationalized analysis by comparing the two parties’ restrictions on the transfer of shares and combining with relevant Chinese laws and regulations.
