惩罚性赔偿制度是英美法系民事损害赔偿普遍采用的一项制度,它弥补了大陆法系民事赔偿制度的不足,对完善我国的民事法律制度具有积极意义。我国已经在产品责任等领域确立了惩罚性赔偿制度,但总体上看还不够完备。我们应该借鉴英美等国家在惩罚性赔偿制度立法和司法实践上的先进经验,完善我国的惩罚性赔偿制度,推进我国的法治进程。 Punitive damages system is a common system of civil damages in Anglo-American law system. It makes up for the inadequacy of civil compensation system in civil law system and has positive significance in improving our country’s civil legal system. China has established a system of punitive damages in areas such as product liability, but overall it is not yet complete. We should learn from the advanced experience of the Anglo-American countries in the legislation and judicial practice of the punitive damages system, improve our punitive damages system and promote the process of rule of law in our country.
