(一)现代企业制度包括一个规范的劳动关系现代企业制度并不仅是一种企业管理制度,而是一种企业体制或微观经济体制,因此,在现代企业制度中必须要考虑到全部的生产要素。在一个企业体制中,所有权与经营权的相互关系,实际上是要具体解决生产资料的占有、运用和收益问题。这只是基本的生产要素的一方。如果这一方不与另一方——劳动者通过一定的规范形式相结合,即形成规范的劳动关系,企业便不可能正常的运作并产生较高的劳动生产率和较高的经济效益。在现代企业制度的发展过程中,那些实行现代企业制度的国家,绝大多数是把规范产权关系、经营关系与劳动关系统筹考虑的。如在现代企业制度的发源地英国,是将劳动立法与公司立法同时,甚至更

In an enterprise system, the relationship between ownership and management rights is actually a matter of resolving the problem of the possession, utilization and return of the means of production in concrete terms. This is only one of the basic factors of production. In the development of the modern enterprise system, most of the countries that implement the modern enterprise system take the norms of property rights, business relations and labor relations into consideration. As in England, the birthplace of a modern enterprise system, labor legislation is incorporated with corporate legislation at the same time.
