社会公益捐赠是一种双方法律行为,在社会公益捐赠过程中签订的捐赠协议属于诺成性合同。社会公益捐赠作为一种特殊的赠与行为,其本质特征在于捐赠目的的公益性,国家对社会公益捐赠的法律制度大都呈现为强制性规范。
Social welfare donation is a legal act of both parties. The donation agreement signed during the donation of social welfare is a promise contract. As a kind of special gift behavior, the social public welfare donation is essentially characterized by the commonweal nature of the purpose of donation, and the legal system of state donation to social welfare mostly appears as a mandatory standard.
