不动产征收是《物权法》的一项重要制度,但《物权法》仅仅规定了公共利益为征收的依据.本文指出征收要依照法律规定的权限和程序进行,并进行补偿,但《物权法》并没有界定公共利益的内涵,也未设计正当征收程序和完善的补偿制度.因此,依据物权法尽快完善我国的征收制度是非常必要的.
