高校科技成果转化制度主要包括科技立法和科技政策,《科学技术进步法》、《促进科技成果转化法》是我国科技法领域的两大基石。国家继2015年修订《促进科技成果转化法》之后,国务院又相继颁布了《促进科技成果转化法若干规定》和《促进科技成果转移转化行动方案》,被视为推进高校院所科技成果转化的“三部曲”。修法背景下,一些地区出台政策先行先试,对高校科技成果转化的体制改革推波助澜,然而政策超前立法范畴导致的稳定性问题和下位规范性文件相对上位法修订的滞后问题仍有待进一步解决。
The transformation system of scientific and technological achievements in colleges and universities mainly includes science and technology legislation and science and technology policies. The Science and Technology Progress Law and the Law on Promotion of Scientific and Technological Achievements are the two cornerstones in the field of science and technology law in our country. After the State revised the Law on Promoting the Transformation of Scientific and Technological Achievements in 2015, the State Council successively promulgated the Several Provisions on Promoting the Transformation of Scientific and Technological Achievements and the Plan of Action for Promoting the Transformation and Transfer of Scientific and Technological Achievements, which are regarded as promoting the transformation of scientific and technological achievements of institutions of higher learning “Trilogy ”. In the context of the revision of the law, the introduction of policies in some areas led the way, leading to institutional reforms in the transformation of scientific and technological achievements in colleges and universities. However, the issue of stability caused by the policy’s advanced legislation and the lag in the revision of the normative documents from the lower-level norms still need to be further resolved.
