我国《消费者权益保护法》(以下简称《消法》)第49条规定对经营者欺诈行为的惩罚性赔偿制度,其在实现维护消费者合法权益的同时也产生了所谓“知假买假、买假索赔”上的所谓“职业维权人”上这一副产品,此后不久,由于这类“知假买假”行为遇到了法律和实务上的尴尬。其中的一部分“职业维权人”开始往“职业维权调查人”转化。本文结合一些笔者所亲历的“职业维权调查”案件的司法实践,对这一较为独特的社会现象对其进行了一些探讨,并就该现象所产生和涉及到的一些问题提出一些具体的观点和立法及规范监管的建议。

This article combines some of the author ’s “professional rights protection investigation ” case of judicial practice, to this more unique social phenomenon to carry on some discussion to it, and to this phenomenon produces and involves some questions put forward some concrete Opinions and legislative and regulatory advice.
