对于个人社会福利资料的完整保护,不仅仅是个人资讯自主权提升至宪法位阶的问题,其本身就是一种动态的文明过程,同时也代表着市民社会在变迁与发展中,与国家权力互动后的整体提升。只有在这种认知下,个人资讯自主权才可能构成社会行政程序法的内涵,成为被保险人或者保险对象的主体权利,遭受侵害时,得依社会法典或者民法侵权行为的规定,请求司法救济。本文除了依行政程序的观点,逐项分析社会福利资讯的作业流程,并依此归纳其规范模式,发现“当事人自主意识”是其主轴,再辅以“职权规定”或者“其他法令依据”的法律保留原则。另外,个人资讯自主权成为基本人权之后,它对于行政法法制发展扮演关键角色,形式上构成宪法主导公法的理论与法制,实质上应该更深入探讨社会变迁对于国家公权力的定义与作用。
