证券市场投资者保护司法救济机制的完善是一个基础性的问题,在多层次资本市场的背景下讨论投资者保护司法救济机制,更加具有现实意义。证券市场投资者保护司法救济机制涉及相关主体权利义务为基础的法律责任制度的整体设计,包括诉讼法律制度的完善,比如诉讼方式、赔偿范围、司法专门化等复杂问题,还涉及投资者权益保护救济机制多元化的问题。从证监会的角度来看,我们始终认为,证券市场监管的主要力量不仅仅是证监会,更是社会各个方面,尤其是司法力量。
