近年来,日益广泛的公众参与成为知识产权法治进程中值得注意的现象。公众对知识产权立法、司法等活动积极关注、发表意见,以及运用知识产权制度实现自身权利,是其参与知识产权法治的两种主要方式。依次分析公众参与知识产权法治的成因、意义及局限,在此基础上提出了更好地发挥公众参与以促进知识产权法治水平的意见。特别地,法治进程中的公众参与是法学领域一个普遍命题,在兼顾一般问题的基础上,结合知识产权法的自身特点着重分析知识产权领域公众参与的特殊之处。
In recent years, the increasingly extensive public participation has become a notable phenomenon in the process of rule of law in intellectual property. The public’s active attention to and formulation of opinions on intellectual property legislation and judicature, and the realization of their own rights through the use of the system of intellectual property are two major ways in which they participate in the rule of law on intellectual property. Analyzes the causes, the significance and the limitations of public participation in the rule of law of intellectual property in turn, and puts forward the opinions on how to better play the role of public participation in promoting the rule of law in intellectual property. In particular, public participation in the process of rule of law is a universal proposition in the field of jurisprudence. On the basis of taking general problems into consideration, the special features of public participation in the field of intellectual property are analyzed in light of its own characteristics.
