由于我国刑事立法的某些缺陷和矛盾 ,公安机关内部条规失当 ,导致当前公安机关刑事执法现状不甚理想 ,其中以下几方面的问题比较突出 ,应引起高度关注并认真加以研究 :1 有的公安机关擅自将刑事立案标准降低 ,导致立案随意不实等种种现象 ,其实规范立案并不意味着公安机关放弃对轻微犯罪深究细查。 2 犯罪嫌疑人不明案件不应进入刑事诉讼程序 ,因为只有明确的控告追诉对象 ,刑事诉讼才能依照法定程序开展。 3 公安机关围绕揭露、证实犯罪的必要调查行为 ,只要符合《刑事诉讼法》内容、程序上的规定 ,无论立案前后 ,其结果均应具有刑事法律效力 ,不能一概而论 ,未经立案的任何侦查活动都是非法的。 4 破案是一个专业术语 ,不是一个法律概念 ,对外使用这似是而非的统计数据 ,无科学和法律依据 ,因而刑事侦查统计内容应包括立案数、撤案数、侦查终结案件数、未结案件及原因较为合理。
