本文通过探讨了英国和我国香港地区对裸聊视频“截取通讯”获得的材料可否作为证据使用的立法现状,并对世界各国的相关立法理由进行了辨析,提出了针对我国的见解:应该赋予检察官决定权,即控方决定是否披露“截取通讯”获得的证据。检察官在作出披露与否的决定前至少应考虑两个因素:从长远看,披露该证据是否会影响到以后的侦查活动;如果不采纳该证据是否会不利于重大的公众利益。
This article explores the status quo of legislation that can be used as evidence for the material obtained in the video chatting between nude chat and the United Kingdom in Hong Kong and the Hong Kong region of our country. It also analyzes the relevant legislative reasons in various countries in the world and puts forward the opinion for our country: Prosecutor’s decision, that is, the prosecution to decide whether to disclose “interception of communications” obtained evidence. Prosecutors should consider at least two factors before making a decision on whether to disclose or not: in the long run, whether disclosure of the evidence will affect future investigation activities; whether the non-admission of such evidence would be detrimental to the significant public interest.
