安监总煤矿[2005]171号各产煤省、自治区、直辖市国土资源厅(局)，各省级煤矿安全监察机构：自《煤矿企业安全生产许可证实施办法》(原国家安全生产监督管理局<国家煤矿安全监察局>令第8号)实施以来，特别是《国务院关于预防煤矿生产安全事故的特别规定》(国务院令第446号，以下简称《特别规定》)、《国务院关于全面整顿和规范矿产资源开发秩序的通知》(国发[2005]28号)和《国务院办公厅关于坚决整顿关闭不具备安全生产条件和非法煤矿的紧急通知》(国办发明电[2005]21号)下发后，各级煤矿安全生产许可证颁发管理机关严格颁证标准、加大颁证工作力度，并联合国土资源主管部门、煤矿安全监管等部门坚决停产整顿不具备安全生产条件的煤矿、关闭非法煤矿，促使煤矿企业进一步提高安全生产设施和条件。针对办理煤矿安全生产许可证的过程中存在煤矿安全生产许可证和采矿许可证有效期不一致的问题，经研究，现就有关情况通知如下：一、对采矿许可证过期或到期的煤矿，一律不予受理煤矿安全生产许可证申请；对已经颁发煤矿安全生产许可证的矿井，采矿许可证过期或到期的，由颁证机关一律暂扣煤矿安全生产许可证，并责令停止生产，直到取得全部证照为止。
