1《道交法》近日修改《道交法》第76条规定(“发生交通事故后,由机动车一方担责”)出台后就一直争议不断。近日,实施了3年多的《道交法》第76条修正案草案提交十届全国人大常委会第三十次会议审议。修改的原则为既不能无限放大机动车的责任,同样也要体现出侧重保护非机动车驾驶人、行人的立法原则。因此,修正案草案将《道路交通安全法》第76条第1款第2项修改为:机动
1 The “Daojiao Law” recently amended the provisions of Article 76 of the “Daojiao Law” (“responsibility of a motor vehicle after a traffic accident occurs”) has been controversial since its promulgation. Recently, the draft amendment to article 76 of the “Road Traffic Law” that has been implemented for more than three years is submitted for consideration at the 30th meeting of the Standing Committee of the Tenth National People's Congress. The principle of amendment is that we can not indefinitely enlarge the responsibility of motor vehicles. We also need to reflect the principle of legislation that focuses on protecting non-motorized drivers and pedestrians. Therefore, the draft amendment amended the second paragraph of article 76, paragraph 1, of the Road Traffic Safety Law to read as follows:
