在累积性创新环境中,专利期限作为政策工具通过影响创新企业的R&D投资决策而影响代表性企业创新周期。本文区分了累积性创新的非侵权情形和侵权情形,在两个情形中专利期限的作用不尽相同:在前一个情形中,企业最优R&D投资决策独立于专利期限政策,而在更常见的后一个情形中,专利期限政策的有效性则视外部条件而定,并且其对技术进步的促进作用随着期限延长而递减。创新速率的提高还依赖于成本条件的改善。
In a cumulative innovation environment, the patent deadline as a policy tool affects the representative business innovation cycle by influencing innovation-oriented R & D investment decisions. This article distinguishes between cumulative infringement of non-infringement and infringement, where the role of patent deadlines differs in both cases: In the former case, the optimal R & D investment decisions of firms are independent of the patent term policy, and in the more common In the latter case, the validity of a patent term policy depends on external conditions and its contribution to technological progress diminishes over time. The improvement of the innovation rate also depends on the improvement of the cost conditions.
