任何权力都有自我扩张的倾向。如何制约政府的权力扩张,从而使其成为有限政府,而不是无限政府呢?要控制政府权力扩张,关键在于建立适当的制度安排,各级政府权力横向配置遵循权力分立与制衡原则,就是制约政府权力扩张、保障有限政府的重要制度安排。这些安排是立宪安排,不能为直接行使政府权力的人所改变。这些安排就是立法、司法和行政权力之间的分立与制衡原则。
